1. Introduction

These terms of use govern the use of the Leak Inspector, a service provided by Identeco GmbH & Co. KG. By using the Leak Inspector, you accept these terms. If you do not agree with the terms, please refrain from using the service.

2. Description of Services

The Leak Inspector offers an analysis of security incidents where personal data has become publicly accessible due to data leaks. The results help users identify potential risks and take measures to improve security. Registered users have access to advanced features and optional paid add-ons. Leak Inspector is also available without an account; however, certain features are only accessible to registered users.

3. Eligibility

The service is available to natural persons aged 16 or older. Leak Inspector is primarily intended for individuals, families, and small teams. For companies, we offer the separate product “Identeco Leak Monitoring”, which allows security officers to use the platform to inform affected employees about risks.

4. User Responsibilities

The user is obligated to use the data and information provided by the Leak Inspector solely for lawful purposes. Unauthorized analyses or misuse of data are strictly prohibited. The user is responsible for complying with all applicable laws, regulations, and internal policies. When using a user account, login credentials must be stored securely. The use of strong passwords and activation of two-factor authentication (2FA) is strongly recommended to prevent unauthorized access to the account.

5. Data Processing and Privacy

Personal data is processed in accordance with our Privacy Policy. The user agrees to use the Leak Inspector in compliance with all applicable data protection laws.

6. Availability and Changes

Identeco strives to keep the Leak Inspector continuously available but assumes no liability for interruptions or disruptions of the service. We reserve the right to change, suspend, or discontinue the service at any time without prior notice. Significant changes to the platform – such as new features, restrictions, or security-relevant adjustments – will be communicated to registered users via the user area or by email. Identeco reserves the right to publish changes that also affect non-registered users on the website.

7. Limitation of Liability

Identeco’s liability is limited to damages caused by gross negligence or intentional misconduct. Liability for indirect damages, lost profits, or data loss is excluded, to the extent permitted by law. The user is obliged to take all possible measures to mitigate damages. Information provided by Leak Inspector is intended for users to assess risks independently and does not constitute a security guarantee.

8. Prohibited Use

It is forbidden to use the Leak Inspector for the following purposes:

• Unauthorized access to or use of data.
• Circumventing security measures or manipulating the service.
• Using the service in a way that affects the integrity or availability of the service.
• Automated queries or crawling.
• Mass requests via scripts or bots.
• Use for fraudulent activities.

Identeco reserves the right to exclude users from the service and to restrict or suspend accounts.

9. Intellectual Property

All content, technologies, and materials provided within the Leak Inspector are the intellectual property of Identeco or its licensors. Use of these materials is only permitted within the framework of these terms of use. Any other use, particularly reproduction, distribution, or alteration of the content, requires the explicit written consent of Identeco. Users may provide feedback to improve the platform. Such feedback may be used by Identeco without giving rise to any claims.

10. Data Processing on Behalf of Organizations

If Leak Inspector is used as part of an organizational security concept, e.g., by a security officer, personal data is processed on behalf of the respective organization.

In such cases, Identeco acts as a data processor within the meaning of Art. 28 GDPR. Processing is carried out on the basis of a separately concluded data processing agreement (DPA) that governs data protection requirements.

11. Termination of Use

Identeco reserves the right to block or terminate access to Leak Inspector in the event of a breach of these terms. Users may discontinue use at any time and request deletion of their Leak Inspector account if one exists.

Upon deletion, all personal data provided during registration and use will be erased in accordance with the Privacy Policy, unless retention is required by law.

12. Changes to Terms of Use

Identeco reserves the right to change these terms of use at any time. Changes will take effect upon their publication on the website. Users should regularly review the terms of use to stay informed about possible changes. Changes affecting registered users will be communicated via the user area or by email. Continued use after changes take effect constitutes acceptance of the new terms.

13. Applicable Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is Bonn, Germany, where legally permitted.

In accordance with § 36 VSBG, we inform you that Identeco is not obligated to participate in dispute resolution proceedings before a consumer arbitration board.

14. Severability Clause

Should any provision of these terms of use be invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid provision will be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
